A grant of probate provides the executor of your will and estate with the legal authority that is necessary for him or her to deal with your estate and eventually to distribute it to the intended beneficiaries. A grant of probate can only be issued if there is an executor named for the estate in the last will of the deceased. If there is no valid will, if no executor was appointed, or if none of the appointed executors is willing to act then a court application will have to be made in order to appoint an administrator for the estate. A grant of administration for the estate is basically the same as a grant of probate in that it gives the administrator the legal powers to administer the estate and eventually to distribute assets to the beneficiaries.
